Wells Fargo has crea! ted a new Senior Discovery Counsel role to focus on the discov! ery strategy and vision for the Company. This role is critical to the long term success of the Wells Fargo discovery program and will report directly to the head of the Litigation and Workout Division. This individual will be consulted by attorneys and paralegals on discovery strategy and evolving case law, will provide leadership to internal Discovery resources and will be responsible for increasing institutional discovery knowledge and awareness of best practices. This role will also work closely with Wells Fargo s Technology Operations Group (TOG), and Records and Risk Management functions to collaborate on cohesive strategies and processes to manage Wells Fargo data. The Senior Discovery Counsel also will focus on identifying and implementing short and long term opportunities for continuous improvement, while ensuring the Wells Fargo discovery strategy is effectively used throughout the Law Department and by external vendors.

Responsibilities:
Discov! ery Program Stewardship

  • Serve as the Company s primary subject matter expert on discovery related issues, including eDiscovery, and advise counsel on Wells Fargo discovery strategy, policy and processes
  • Monitor and educate on evolving discovery legal standards and associated impacts on Company policies and best practices
  • Serve as the primary liaison with the Technology Operations Group (TOG), and Records and Risk Management functions to ensure the Company is working towards cohesive discovery strategies and processes
  • Maintain close relationship with Legal Finance Operations team and collaborate to develop, refine and maintain key data, metrics and reporting for the Law Department and Business Units
  • Determine need for and oversee engagement of National Discovery Counsel (external), when necessary
Discovery Case Strategy & Guidance

  • Serve as the first line, day-to-day point for attorneys and par! alegals on case specific discovery strategy needs
  • Collaborate ! with Wells Fargo attorneys and paralegals, outside counsel and the Legal Discovery Team ( LDT ), as appropriate, on early discovery planning to determine appropriate discovery scope, identify custodians/data sources, and ensure preservation of data
  • Participate in meet and confer sessions and other discovery-oriented legal proceedings, as appropriate, with Wells Fargo attorneys and paralegals, outside counsel and LDT
  • Aid Wells Fargo attorneys and paralegals and outside counsel in establishing effective data culling approaches to ensure the most accurate and efficient culling practices are being applied
  • Coordinate with Wells Fargo attorneys and paralegals and outside counsel to facilitate compliance with document review, redaction and privilege log protocols to ensure the most efficient and cost effective document review methods are used
  • Collaborate regarding ESI production protocols
  • Serve as a 30(b)(6) witness, when appropriate
Continuous Improvement

  • Coordinate with Legal Operations, LDT, and Supply Chain and advise on potential modifications and/or improvements in multiple areas, including but not limited to: processes/procedures, vendor relationships, and technology
Basic Qualifications:
  • J.D. Degree
  • 10+ years of practicing law
Minimum Qualifications

  • 5+ years of in-depth eDiscovery experience inside a corporate legal department or at a law firm, including experience in litigation support and hard-copy and electronic discovery practices
  • 3+ years of leadership experience
  • Previous experience creating financial forecasts and managing budgets
