Description
Monitors the processing of bankruptcy claims and deed in-lieu of foreclosure requests and evaluates all aspects of each loan on a case by case basis to minimize losses and exposure while adhering to State and Federal law, and government policies and procedures. Prepares and monitors foreclosure actions inside and outside TCF while following State and Federal laws and government regulations.
Obtains bankruptcy notice and stops all foreclosure and collection activity. Establishes a bankruptcy file and system for documentation or pre- and post- petition payments. Analyzes the value of the collateral and reports any loan that is under secured to Supervisor.
Files appropriate claim and attends, if necessary, first meeting of creditors. Prepares and files reaffirmation agreements with the Bankruptcy Court. Maintains current knowledge of corporate, and government agency guidelines as well as laws and regulations of U.S. Bankruptcy Court.
Monitors and records all payments received; and contacts debtor’s attorney if default occurs. Makes a recommendation to department management for a Lift of Stay. Orders legal documents, loan histories and prepares a Lift of Stay packet based on set guidelines.
Receives and processes all deed-in-lieu of foreclosure requests. Orders the property valuation and title search. Presents report to department management for final decision.
Monitors foreclosure sales and tax sales outside TCF Bank, and takes the steps necessary to redeem from outside parties. Reviews legal notices, condemnation notices, and summons and complaints related to TCF properties and takes appropriate action to protect our interest.
Receives files recommended for foreclosure and prepares a foreclosure packet to submit to an attorney per set guidelines. Prepares specific legal documents related to foreclosures, such as a Certificate of Redemption, an Affidavit of Amount Due, or a Notice of Intent to Redeem.
Processes redemptions with the Sheriff’s Department or an attorney. Arranges payment of the state deed tax, property taxes, redemption checks and recording fees related to redemption upon department management approval.
Processes all work-related invoices. Establishes and removes holds on accounts to comply with internal and external regulations. Performs other duties as assigned.
Qualifications
High School Education or equivalent
2 years prior collection experience
Strong organizational skills
Strong verbal and written communication skills
Strong math aptitude
Preferred Qualifications
One or more years of business or vocational school.
One year foreclosure or legal assistant experience
Working knowledge of other aspects of mortgage servicing
Knowledge of Bankruptcy laws
