Under the direction of the Division Manager, the Assistant County Attorney III is responsible for providing legal services and representing the County, State or local municipalities in a wide variety of complex civil, criminal or juvenile matters. Duties include providing legal advice and training to county divisions/employees/officials; conducting legal research; evaluating, preparing, and presenting cases in legal proceedings including motions, hearings, trials and appeals; and preparing and drafting legal documents.

This classification represents the third level in a four level Assistant County Attorney classification series. The classification of Assistant County Attorney III differs from Assistant County Attorney II in that it represents the "senior level" within the occupational/classification series. Persons assigned to the Assistant County Attorney III are very experienced in all legal matters in their areas of law and are given more complex assignments. Duties, responsibilities, and cases assigned are more involved and require a greater degree of sophistication than is assigned to the Assistant County Attorney II. Assignments for the Assistant County Attorney III are performed under significantly less technical supervision and direction than Assistant County Attorney II and require a greater breadth of experience. The Assistant County Attorney III leads and coordinates the completion of assigned work of support staff, paralegals and law clerks, as well as provides mentoring and advice to Assistant County Attorneys I and II, and law clerks. Work is reviewed by the Assistant County Attorney III and when the work results in opinions, pleadings or advice that are issued outside the of the County Attorney's Office, the work goes out under the signature of the Assistant County Attorney III. The Assistant County Attorney III exercises independent judgment and uses their breadth of experience regarding matters of law including charging cases, case review, case management, negotiations and settlements.

TYPICAL DUTIES AND RESPONSIBILITIES:

  • Represents the County, State or municipalities in court proceedings, legal proceedings or administrative hearings including all criminal, civil or juvenile proceedings as assigned.
  • Provides mentorship for Assistant County Attorney I's and II's. Advises and trains county divisions, employees and other agencies (e.g., law enforcement) on matters of law or significant legal issues or trends that impact operations and procedures. Advises county employees and represents the work of county employees as it relates to legal proceedings and issues. Responds to general questions of the public concerning legal issues.
  • Reviews cases and legal information to determine appropriate legal actions on behalf of the County, State or municipality.
  • Drafts and prepares, or coordinates the preparation of various legal documents including letters, stipulations, affidavits, briefs, complaints, legal memoranda or other documents necessary in pending legal actions.
  • Drafts appellate briefs and appears at subsequent presentation of arguments before the higher courts. Provides research, writing and trial support for the County Attorney or other legal staff, as assigned.
  • Performs other duties of a comparable type and level, as assigned.
MINIMUM QUALIFICATIONS:
  • Juris Doctoral degree in law from an accredited law school; and
  • Six (6) years of experience as an Assistant County Attorney or equivalent experience as a practicing attorney; and
  • A Valid Minnesota Driver's License or ability to obtain within 60 days of hire; and
  • Licensed to practice law in the State of MN.
SCORED EXAMINATION PROCESS:
All applications will be screened for minimum qualifications, scored and ranked. The highest ranked candidates meeting minimum qualifications will be recommended for the scored oral examination (interview) and any required performance/ability tests required to demonstrate proficiency for the position. Final selection for the position will include successful completion of oral interviews and a background investigation.
